Between 1960 and 1995, an aircraft manufacturer designed and sold fixed-wing aircraft. These seats were designed with steel pins inserted into the aluminum rails to allow for seat adjustment.

 

However, allegations surfaced that the combination of aluminum and steel together caused the rails to wear, resulting in the pilot seat slipping. As a result, several accidents were reported, including fatalities, which occurred over a 20-year period. The Federal Aviation Authority and the National Transportation Safety Board have investigated these incidents.

The manufacturer in these instances claimed that there was no defect, refusing to acknowledge any responsibility. Swartz & Swartz, P.C. successfully represented two victims of such a defect, fighting a long battle for justice culminating in a jury trial in Massachusetts seeking compensatory damages.
