Plaintiff, a 2-year-old boy, was on a couch in his grandmother’s home. His mother was in the same room with him and suddenly noticed that the child was crying and holding his eye.

 

He had been struck in the eye by a metal clip attached to an elastic band which was part of a ready-made slipcover purchased by his grandmother. The elastic band acted like a “slingshot” and propelled the clip into the child’s eye. As a result the child was caused to lose his vision in that eye.
