While waiting for a subway train, a woman fell onto the tracks where she lay until run over by an oncoming train, causing paralyzing injuries.

 

The plaintiff brought suit on the theory that the platform and track area was negligently designed because there existed no system to detect her presence on the tracks and warn or stop approaching subway trains.
