The mug broke and a glass shard pierced the neck of 23-year-old Michael DiMaria of Hicksville, NY. Mr. DiMaria, who was not involved in the argument, was taken to Brigham & Women’s Hospital after the glass pierced his jugular. He was pronounced dead soon thereafter. Mr. Guardiola was charged with manslaughter and assault and battery with a dangerous weapon.
